Impac Engineering Ltd., C.P. 510678006 (hereinafter: the “Company”), respects the privacy of users of its website, available at https://impac.co.il (hereinafter: the “Site”). Any person who browses or uses the Site is referred to below as the “User.”

This Privacy Policy explains what personal information may be collected through use of the Site and when contacting the Company through the Site, how the Company uses such information, to whom it may disclose it, and what rights data subjects have. This Policy also applies to the ongoing handling of an inquiry initiated through the Site, including correspondence with the Company by email, telephone call, meeting, request for information, professional or commercial inquiry, or receipt of an offer from the Company.

The Company controls the personal information collected through the Site and in connection with inquiries received through it. Use of the Site is also subject to the Company’s Terms of Use.

The Site is not intended for minors, and the Company does not knowingly collect personal information from minors without the consent of a parent or guardian, to the extent that such consent is required by law. If the Company becomes aware that such information has been collected unlawfully, it will act to delete it, subject to applicable law.

In this Policy, the term “personal information” means data relating to an identified or identifiable natural person. An “identifiable natural person” is a person who can be identified with reasonable effort, directly or indirectly, including by means of an identifier such as a name, identity number, biometric identifier, location data, online identifier, or one or more factors specific to the person’s physical, health, economic, social, or cultural situation, all as these terms are defined in the Privacy Protection Law, 5741-1981 (the “Privacy Protection Law”).

Providing Information to the Company

Providing personal information to the Company is voluntary. The User is not legally required to provide the Company with personal information through the Site.

However, without providing the information marked as mandatory in the relevant form, the Company may be unable to handle the request, contact the User, provide information, assess the User’s needs, or prepare an offer.

The User is requested to provide accurate, complete, and up-to-date information. If the User provides the Company with personal information relating to another person, the User must ensure that they are authorized to do so and that the information is provided lawfully.

What Information Do We Collect?

Information Provided by the User

When filling out a form on the Site, contacting the Company, or continuing correspondence with the Company, the Company may receive, among other things:

(a) first and last name;
(b) telephone number and email address;
(c) the name of the company or organization represented by the User, the User’s position, and business contact details;
(d) the content of the inquiry or message submitted to the Company;
(e) information regarding the field of activity, product, raw materials, production needs, production line, machine, system, or solution in relation to which the inquiry was made;
(f) professional, technical, or commercial information that the User chooses to provide for the purpose of reviewing the inquiry; and
(g) information contained in correspondence, conversations, meetings, requests for quotations, and documents submitted as part of continued contact with the Company.

Information Collected When Using the Site

When browsing the Site, technical information and information regarding how the Site is used may be collected automatically, including:

(a) IP address;
(b) device type, operating system, and browser type;
(c) date and time of browsing and duration of the visit to the Site;
(d) pages and content viewed on the Site;
(e) actions performed on the Site, including clicking links or playing videos;
(f) the website address or referral source from which the User reached the Site;
(g) communication, performance, failure, and information security data;
(h) online identifiers and information stored using cookies or similar technologies; and
(i) general location information that may be inferred from the IP address or device settings, with varying degrees of accuracy.

Such information may be collected by the Company or through service providers that provide storage, maintenance, security, usage-data analysis, or external content embedded on the Site.

The User is requested not to submit sensitive or confidential information through the Site’s standard forms unless it is necessary for handling the User’s request. Sensitive technical or commercial information should be submitted only after the need for such information has been examined and through appropriate means of transmission.

Purposes of Using Information

The Company may use the information collected for the following purposes:

Operating, maintaining, and managing the Site;
Receiving inquiries, providing responses, and contacting the User;
Understanding the User’s needs and assessing the suitability of the machines, systems, production lines, services, or solutions offered by the Company for the User’s needs;
Preparing initial proposals, quotations, specifications, and professional or commercial information requested by the User;
Managing ongoing contact with customers, potential customers, suppliers, and business entities that have contacted the Company;
Providing service and support and responding to professional or technical inquiries;
Improving the Site, its content, the user experience, and the Company’s services;
Analyzing Site browsing and usage data, producing statistical data, and measuring Site performance;
Detecting, preventing, and handling malfunctions, misuse, intrusion attempts, fraud, and information security incidents;
Protecting the rights of the Company, its employees, customers, and third parties, resolving disputes, and conducting legal proceedings;
Complying with legal provisions, requirements of competent authorities, and obligations applicable to the Company;
Maintaining business, professional, accounting, and legal records;
Sending professional information, updates, and marketing offers, where consent has been provided or where such sending is permitted by law; and
Any other purpose explained to the User at the time the information was collected or for which the User provided consent.

Without limiting the above, the Company may use information, including aggregated, anonymous, or non-identifying information, for purposes of analysis, research, development, and improvement of services, as well as for creating insights, models, statistics, or derivative products, provided that such information does not personally identify the User.

Marketing Communications

The Company may send the User professional information, updates, and offers relating to its activities where the User has provided consent or where such communications are permitted by law.

The User may request at any time not to receive further marketing communications by using the unsubscribe mechanism included in the message or by contacting the Company using the contact details provided at the end of this Policy. A request to stop marketing communications will not apply to messages required to respond to an inquiry, manage an existing business relationship, provide a service, or comply with a legal obligation.

Providing Information to Third Parties

The Company will not provide personal information to third parties except to the extent required for one of the purposes detailed in this Policy and in one of the following circumstances:

To the Company’s employees and entities acting on its behalf that require the information to perform their duties;
To service providers that provide the Company with storage and cloud services, computing, information security, Site maintenance, development, online forms, email, customer relationship management, backup, data measurement, and data analysis services;
To service providers that assist the Company in providing services, operating its activities, conducting marketing, or managing customer relationships, subject to any consent required by law;
To the Company’s professional advisors, including lawyers, accountants, tax advisors, auditors, insurance companies, and technology consultants;
To a competent authority or a party to legal proceedings where disclosure is required by law, judicial order, legal requirement, or for the purpose of conducting legal proceedings;
Where disclosure is necessary to prevent damage, fraud, misuse, violations of law, or harm to the security of the Site, the Company, Users, or third parties;
As part of a restructuring, merger, acquisition, investment, transfer of activity, sale of assets, or due diligence in connection with such a transaction, provided that the recipient of the information is subject to appropriate confidentiality and use obligations; or
In accordance with the User’s request, instruction, or consent.

Service providers that process information on behalf of the Company will be permitted to use the information for the purpose of providing services to the Company and in accordance with their agreements, applicable law, and the scope of their services.

External services embedded on the Site may process information as independent controllers. Their use of information will be subject to their respective privacy policies and terms of use.

The User waives any claim or demand against the Company and/or anyone acting on its behalf in connection with the provision of the User’s personal information as described above.

Transferring Information Outside of Israel

Some of the Company’s service providers may operate systems, servers, or teams outside of Israel. Accordingly, personal information may also be stored or processed in other countries. Transfers of information outside of Israel will be made in accordance with applicable law and, where necessary, using contractual arrangements or appropriate safeguards.

The laws of the country to which the information is transferred may provide a different level of protection from that provided in Israel.

Cookies and Similar Technologies

The Site may use cookies and similar technologies to ensure its proper and secure operation, save User preferences, measure Site usage, detect errors, and improve the browsing experience. Cookies are small data files stored in the User’s browser or device.

Some cookies are essential for the proper operation of the Site. Other cookies may be used for functional purposes, measurement, and analysis of usage data. To the extent that the User’s consent to the use of non-essential cookies is required by law, such cookies will be used in accordance with the User’s choices through the cookie mechanism presented on the Site.

The Site may include content or services operated by third parties, such as Vimeo and other video services. These third parties may set cookies or collect information when the User interacts with embedded content, in accordance with their privacy policies.

The User may manage cookie preferences through the mechanism presented on the Site or through the User’s browser settings. Blocking certain cookies may affect the availability or functionality of parts of the Site.

Retention of Information

The Company will retain personal information for the period reasonably necessary for the purposes for which it was collected, including handling an inquiry, managing a business relationship, providing services, maintaining records, protecting the Company’s rights, and fulfilling legal obligations.

When determining the retention period, the Company will take into account, among other things, the type of information, the purpose for which it was collected, the nature of the relationship with the User, and applicable law.

Information Security

The Site uses information security systems and procedures designed to protect the information. While these systems and procedures reduce the risks of unauthorized access, they do not provide absolute security. Accordingly, the Company does not warrant that the Site’s services will be completely immune from unauthorized access to information stored through the Site.

Right to Review, Update, and Delete

Information provided by the User through the Company’s Site is provided voluntarily and will be stored in the Company’s databases for the purposes detailed in this Privacy Policy.

According to Section 13 of the Privacy Protection Law, 5741-1981, every person has the right to review information about them held in a database. A person who reviews information about themselves and finds that it is inaccurate, incomplete, unclear, or not up to date may contact the Company with a request to correct or delete the information.

Information may also be deleted in other circumstances, in accordance with the rights granted under the Privacy Protection Regulations (Provisions Concerning Information Transferred to Israel from the European Economic Area), 2023, to the extent applicable to the relevant case. In this context, a person may be entitled to request the deletion of information collected about them that they did not provide directly to the Company, to the extent that such information is not required for law enforcement or the protection of state security in accordance with the law.

However, the Company may retain information about the User after a deletion request to the extent required or permitted by law, including for the purpose of maintaining records, documenting actions taken on the Site, managing or defending legal proceedings, collecting debts, preventing fraud or abuse, enforcing the Terms of Use, fulfilling legal or regulatory obligations, or protecting a public interest or other legitimate interest of the Company.

Changes to the Privacy Policy

The Company may change or update this Privacy Policy from time to time without prior notice. Any changes or updates will take effect upon publication on the Company’s Site. Continued use of the Site following publication of an updated Privacy Policy will constitute acceptance of the updated Policy.
